The Global Intellectual Property Battle: Protecting Traditional Knowledge from Bio-Piracy

The Traditional Knowledge Digital Library (TKDL) is a pioneering initiative developed by India to safeguard its rich traditional medicinal knowledge from bio-piracy and misappropriation through erroneous patent claims. By systematically documenting classical Ayurvedic, Unani, Siddha, and Yoga literature in internationally accessible formats, TKDL serves as a bridge between traditional knowledge and modern intellectual property systems. This review explores the evolution, structure, and global significance of TKDL in preventing the patenting of prior art, with particular emphasis on Ayurvedic knowledge. It also discusses major bio-piracy cases, the role of international intellectual property frameworks, existing challenges, and future strategies for strengthening global protection of traditional medicinal heritage.

      Suggested focus:

It can examine how Ayurveda and other Indigenous medical systems can use intellectual-property frameworks, traditional knowledge databases, documentation, prior-art evidence, benefit-sharing mechanisms, and international cooperation to safeguard community knowledge.
